The Trump administration said Tuesday it will pursue enforcement actions that could include withholding federal funding from Kansas City, Kansas Public Schools for policies the administration says prevent staff from informing parents of a transgender student’s gender.
The Department of Education said Kansas City, Kansas Public Schools’ policy of not disclosing a transgender student’s status to their parents violates the Family Educational Rights and Privacy Act.
The agency announced that it will work with the Department of Justice to take “appropriate enforcement action,” including active prosecution and possible loss of federal funds.

“Kansas City Kansas Public Schools’ continued efforts to circumvent FERPA, hide its true policies, and prevent parents from legally accessing their children’s education records represent a serious and willful violation of federal law,” said Frank Miller, Director of the Office of Student Privacy Policy at the Department of Education.
“Strong and systematic cooperation between the Department of Education and the Department of Justice will ensure that districts are accountable and fully respect the rights of parents,” he added.

According to the government, district policy ensures that school staff “should not disclose information that may reveal a student’s transgender status or non-conforming gender presentation to others, including parents.”
“Despite the Department’s Proposed Settlement Agreement, which outlines specific steps the District must take to remedy its FERPA violations, the District continues to ignore the federal parental rights law,” the Department of Education said.

Earlier this year, the Department of Education said policies regarding transgender students in four Kansas school districts, including Kansas City and Kansas Public Schools, violate federal law.

President Donald Trump has issued an executive order aimed at preventing transgender women and girls from competing in girls’ and women’s sports. The US Supreme Court on Tuesday ruled that states can ban transgender women and girls from girls’ and women’s sports, upholding the laws of Idaho and West Virginia while not requiring states without such bans to adopt them.
