The Karnataka government on Thursday decided to revoke the general permission given to the CBI to investigate cases in the State.
“The notification giving general permission for the CBI to investigate criminal cases in the state of Karnataka, under the Special Police Establishment Act, 1946, has been withdrawn,” Law and Parliamentary Affairs Minister HK Patil said after the Cabinet meeting, chaired by the Chief Minister. According to section 6 of the Delhi Special Police Establishment (DSPE) Act, 1946, the Central Bureau of Investigation (CBI) needs permission from the respective state governments to conduct investigations in their jurisdiction.
Speaking to reporters here he said: “It has been done because it is clear that the CBI or the central government while using their instruments are not using them wisely. Therefore, in each case we will verify and give (permission for CBI probe), the general permission has been withdrawn.”
Asked if this was done to “protect” the Chief Minister who is facing an investigation in the Mysuru Urban Development Authority (MUDA) land allotment case, Patil said: “The CM has a court order for Lakayukta’s investigation, so that is the question.”
He said there are concerns raised “day by day” that the CBI is being misused in many cases.
Even in the cases that the state government has handed over to the CBI or the agency that has taken them over, in a few cases they have not been filed, said Patil. “They (CBI) refused to file charges, they refused to investigate twelve mining cases.”
Asked whether the government has done this keeping in mind the need for a CBI investigation into the Karnataka Maharshi Valmiki Scheduled Tribe Development Corporation case by the BJP, the Minister said: “It has nothing to do with this as the matter is in court. The court will decide.”
