Joe Biden is fighting to suppress the recording of classified documents

Joe Biden’s repeated cover-up game about the alleged theft of highly sensitive government documents may finally be coming to an end.

The Department of Justice announced, “Good or bad, I’m coming!” So, the former president jumped into federal court on Tuesday, seeking immunity to prevent the public release of audio recordings and documents known to have incriminated him.

Asking a judge to effectively suppress evidence of crimes – whether they are charged or not – is a false proposition.

The recordings were officially discovered in 2023 by then-special counsel Robert Hur. Therefore, Biden can no longer claim a Fourth Amendment privacy interest in them. Once they enter the public and prosecutorial domain, they are stripped of privacy protections.

Well, that’s Biden’s argument. He is suing the DOJ to block him from providing the recordings to Congress and the Heritage Foundation, which had previously sought the tapes under the Freedom of Information Act.

The facts established by Hur’s investigation show that Biden kept (or stole) a large number of secret documents while he was a member of the US parliament and, later, vice president. They were stored in his home, garage and office at the Penn Biden Center. These were unsecured and unauthorized sites, in violation of the Espionage Act (18 USC 793-798). His actions threatened the security of the country.

Even worse, Biden can be heard on the recording sharing classified information with his ghost, Mark Zwonitzer, who also violates the act. The author did not have security clearance. All this is confirmed in Hur’s 345-page report released in 2024.

On the first page of that report, Biden’s case was laid bare:

“Our investigation revealed evidence that President Biden intentionally withheld and disclosed classified material after he became vice president while he was a private citizen. These documents included (1) classified documents regarding military and foreign policy in Afghanistan, and (2) notebooks containing Mr. Biden’s handwritten notes on national security and foreign policy matters involving sensitive intelligence sources.”

Why did Biden take and keep secret records and turn them to his own use? As Hur explained in his report, “Biden has long seen himself as a history-maker… He used these books to write memoirs that were published in 2007 and 2017, to write his own history, and to present as evidence that he was a man of the presidential woods.”

In other words, hubris is what drove Biden to flout the law with impunity. He knowingly treated secret government documents as his personal property. When interviewed by Hur, Biden kept referring to them as “my property,” as if strict federal rules against that didn’t apply to him.

Biden should have been charged with multiple charges stemming from the Espionage Act, which makes it a crime to knowingly retain or transmit classified documents. There is also a lesser degree of “gross negligence.” To comply with DOJ policy, charges could be dropped until he leaves office. But that didn’t happen.

Why was Biden saved? The most obvious explanation was his anger. This was noted negatively by Hur when he wrote that the sitting president at the time was “a sensitive, well-intentioned, elderly man with a bad memory. The special counsel concluded that Biden lacked the necessary strength for a “resolute attitude.” This ignored the level of gross negligence.

Hur also offered a soufflé of other empty excuses, many of which focused on Biden’s declining mental acuity. At one point, the prosecutor even testified that skipping the many boxes and notebooks of secret documents was “just a pure mistake.” That, contradicts Hur’s explanation that Biden wanted to remember his place in history by confiscating things.

The likely truth behind Biden’s good treatment is that his Justice Department has been investigating its boss. Refusal to re-indict mixed with cover-up of corruption.

How else can one explain the paradox of a man who is said to be impeachable but is perfectly fit to continue as president of the United States? And, at that time, he ran for another four years?

Juxtapose Donald Trump’s harsh treatment when he left office and, like Biden, he was a private citizen when he kept allegedly classified documents. Despite cooperating with DOJ and FBI inquiries, Trump’s Mar-a-Lago home was raided and criminal charges followed.

The Presidential Records Act allowed Trump to keep classified material. Indeed, this was the long-standing position of the Justice Department until it suddenly reversed itself in the Trump case. Biden, however, was unable to secure similar protections from the Presidential Records Act, as many of his classified records date back to his career as a congressman.

In Hur’s report, he noted that “after leaving office, many former presidents and vice presidents have deliberately taken sensitive matters related to national security in their positions without being charged with crimes.” However, Trump was impeached and Biden was not. The inconsistent and unfair administration of justice is what many Americans have resented. There are rules for Trump – and rules for everyone.

This biased and racist system is what Biden now intends to take advantage of in court. He wants to hide the hard evidence from the public and Congress when, according to Hur, he freely admits to his ghostwriter that he pulled out top secret records and read them verbatim.

The author removed his digital audio recording but was later granted immunity. Erasures were also found on his computer and hard drive. All the while, Biden kept telling reporters that he never once shared classified information.

Biden’s deliberate deception is reason enough to make those tapes public. The American people have a right to know the truth and to answer for themselves whether their president has been lying. They have the right to listen to the recording or simply read the transcript. Some recordings have already been released. But all material must be made available.

As a public figure who held the highest office in the land, Joe Biden’s privacy rights are circumscribed. The recordings he wants to delete contain evidence that he mishandled confidential information.

Their release serves the greater public interest. They are by no means personal, private records.
