The ex-prisoner convicted of murdering Richard Glossip is to be released on bond as he awaits a retrial in the 1997 murder in which he nearly killed himself three times – and applied for food for the last three.

Considering the “extensive” record in Glossip’s case, Judge Natalie Mai found on Thursday that she would not deny bail to the long-time inmate, who was convicted of first-degree murder in 1998.

He set bond at $500,000 and ordered Glossip to remain in Oklahoma wearing an electronic monitoring device.

The ruling comes after the U.S. Supreme Court in February overturned Glossip’s death sentence, finding that prosecutors failed to correct the false testimony of key witness Justin Sneed, the convicted murderer who avoided execution by testifying against Glossip.

The high court ordered a new trial, citing concerns that jurors had not heard critical information about Sneed’s mental health history and credibility.

In Thursday’s order, Mai noted an unusually extensive record built up over nearly three decades of litigation and said the state cannot meet the high constitutional standard required to deny bail in a capital case.

In a statement sent to Fox News Digital, Glossip’s attorney, Don Knight, said that Glossip has eaten the last three amazing meals and will get a chance to “taste freedom.”

“We are very grateful that Judge Natalie Mai granted bond to Richard Glossip. By doing this, he rejected what the State said that there is a strong case. For the first time in the 29 years he was imprisoned for a crime he did not commit, when he faced the nine days of his murder he ate his last three meals,” said Knight.

“Mr. Glossip now has a chance to taste freedom while his defense team continues to pursue justice on his behalf against a system the United States Supreme Court found guilty of serious misconduct by federal prosecutors. Mr. Glossip is grateful to the many thousands of people who have shown him support over the years and now looks forward to the day he is truly freed this decade.”

He was convicted of murdering his former boss Barry Van Treese in 1997. The motel owner was beaten to death by Sneed, a repairman, but federal prosecutors said Glossip ordered him to commit the crime in a conspiracy to get hired.
