The Supreme Court on Monday refused to listen to the request for compensation of people in the event that the government authorities demolish their houses. The high court said the matter was closed then asked the applicant to withdraw the application, which was eventually done.
The application argued that wherever there is damage due to tractor actioncompensation should be given to the victims, and the names of the officials involved, as well as those involved, should be revealed.
The bench led by Justice BR Gavai refused to entertain the case and said, “The matter is closed for judgment. Either you withdraw it, or we will reject it.” The lawyer then agreed to withdraw the request.
On October 1, the Supreme Court reserved its decision on a number of appeals against the use of bulldozers to demolish buildings allegedly linked to criminal activities, citing illegal construction. This practice, often referred to as “bulldozer justice,” has been the subject of much controversy, with allegations of religious bias.
The state governments had argued that the demolitions were being carried out in buildings on occupied land or those that were constructed illegally. During the hearingthe court noted that buildings can be demolished in the event of illegal construction or vandalism. However, the high court emphasized that no layoffs should be made except based on the criminal records of individuals, even if the person is convicted of a crime. The court said state governments should seek its permission to demolish illegally constructed structures.
The Supreme Court also said it will issue pan-India guidelines to address concerns about demolition of houses and buildings.
While reserving its verdict, a bench of Justices BR Gavai and KV Viswanathan also observed that India is an atheistic country and that its guidelines on bulldozer operations and anti-robbery campaigns will apply irrespective of religion.
