The Supreme Court orders notice to the TNUSRB chairman by letter confirming its existence

The Madras High Court on Friday issued a notice to Tamil Nadu Uniformed Services Recruitment Board (TNUSRB) chairman Sunil Kumar, a retired Director General of Police, on the writ petition. quo warranty asking about the authority of the person holding this position.

Senior lawyer V. Raghavachari, representing the petitioner, contends that Mr. Kumar does not have the necessary qualifications to hold the post of TNUSRB chairman. To substantiate his submission, he urged the court to strictly follow the Indian Police Service (Cadre) Rules, 1954.

The senior counsel submitted that the term ‘Cadre Officer’ shall mean a member of the Indian Police Service and ‘Cadre Post’ shall refer to the post specified under section 1 of each card in the schedule of the IPS (Cadre Strength Adjustment) Regulations, 1955.

He also relied on Rule 8 and submitted that all ‘Vacancies’ can be filled only by ‘Cadre Officer.’ The 2018 amendment included the post of TNUSRB chairman during the system and therefore, a retired IPS officer could not be appointed to the post, he said.

Mr. Raghavachari also submitted that a Government Order (GO) was issued on November 29, 1991 to allow retired DGPs and retired Inspector Generals of Police to hold the post of TNUSRB chairman. However, the GO has been inactive since it was amended in 2018, he said.

As the Special Advocate of the Government P. Baladhandayutham seeking accommodation to appear Advocate General PS Raman, the judge decided to continue the case for the final hearing on October 25.
