The Supreme Court has ordered a man to pay Rs 5 crore as a lump sum to his wife as permanent alimony after agreeing to the dissolution of their marriage.
The verdict was delivered by a bench comprising Justice Vikram Nath and Justice Prasanna V. Varale, who emphasized the need for the husband to fulfill his parental responsibilities towards the couple’s son.
The court also ordered the husband to shell out Rs 1 crore for financial security and maintenance of his grown-up son.
The case pertains to a matrimonial dispute between Praveen Kumar Jain and Anju Jain. The couple has been living apart for more than two decades.
Allegations of incompatibility and a troubled relationship had marked their marriage. While Praveen accused Anju of being overly sensitive and not caring about her family, Anju blamed Praveen’s mistreatment.
Noting that the marital bond was irretrievably broken, the court granted the divorce with certain conditions.
The bench based its judgment on eight key factors: the socio-economic status of the husband and wife, the basic needs of the wife and children in the future, the strength and employment of both parties, the sources of income and property of both people, the extent to which the wife lived with her father-in-law, regardless of whether the wife had left him. her duty to take care of the family, the provision of reasonable costs to sue the non-earning wife, the financial condition of the husband and his responsibilities. maintenance and upkeep.
The court noted that both spouses did not have the opportunity to fulfill their marital obligations during their long separation, which led to the conclusion that their emotional and relational ties were irreparably severed.
