Kolkata rape case: Allegations against RG Kar ex-principal Sandip Ghosh may attract death sentence: CBI court


A CBI-appointed court, refusing bail to the former principal of RG Kar Medical College and Hospital, Sandip Ghosh, observed that the nature and gravity of the crime against him was heinous, and could carry the death penalty if proven.

The CBI has arrested Ghosh and the former officer-in-charge of Tala police station, Abhijit Mondal, for allegedly tampering with evidence and delay in filing an FIR in the rape and murder of a doctor at a government-run hospital on August 9.

The court in its order, which came out on September 25, said it appears that the investigation by the main investigative agency is still ongoing.

Denying Ghosh’s bail prayer, Chief Justice US Dey observed that the nature and gravity of the allegations were serious and if proved, could attract the death penalty, which is given in rare cases.

The judge said the court was of the view that “it would be unfair to violate the principle of equality to release the accused on bail”.

He said that in order for a person to commit a crime with the help of others, there is no need for the presence of another defendant where he committed the crime.

The court also rejected Abhijit Mondal’s bail plea. It allowed the CBI’s prayer for protection of the two accused till September 30.

Ghosh’s lawyer said before the judge at the Sealdah Court here that he is involved in this case, and there was no act of his to commit this crime as was alleged.
