A Delhi court has dismissed a plea filed by a Rashtriya Swayamsevak Sangh (RSS) member to direct the police to register an FIR against Congress president Mallikarjun Kharge. The complaint sought action against Mr Kharge over comments he had made against Prime Minister Narendra Modi at a rally in Karnataka in April last year.

However, on December 9, court magistrate Chatinder Singh heard Adv Ravinder Gupta’s appeal and recorded his statement.

Mr. Gupta said the Congress President delivered a “hateful speech” on April 27, 2023, when he made harsh remarks against the Prime Minister. He pointed out that on the same day, Mr. Kharge, in other election meetings, clarified that his statement was not directed at Mr. Modi but we are targeting RSS and Bharatiya Janata Party.

“….being a member of RSS the complainant feels insulted as he is an ardent follower and an active member of RSS,” added the complainant.

The court said that all the material related to this case is available to the complainant and no technical or complex investigation is required by the police. It observed that all the accused were confirmed in the complaint and therefore there was no need for the police to find the truth, and there was no need for an investigation.

“The evidence is available to the complainant and no police assistance is needed to collect it. The facts of this case do not warrant a detailed and complex investigation to be conducted by a government agency,” said the court while rejecting the request to file an FIR against Mr.

The court posted the matter for hearing on March 27, 2025.
