Thousands of homeowners have been given notices to restart (take over) their properties if solar plants are not installed on their homes within two months.
Notices have been issued by the Chandigarh housing office for violating building regulations.
The notices issued by the Chandigarh local office state that in case the owner does not ensure compliance within two months of this notice, his property will be resumed/cancelled under the provisions of the said bye-laws.
Deputy Commissioner Vinay Pratap Singh confirmed and said, “More than 4,000 notices have been sent to owners of houses of 500 square meters and above.”
What is the notice
“Since you are the tenant/transferor/assignor of the plot number as mentioned above. As per the data received from Chandigarh Renewable Energy and Science & Technology Promotion Society (CREST), Chandigarh Administration, it has been observed that you have not installed solar power plant on the roof which is a mandatory requirement as per Rule 4.1 of Chandigarh Building Rules (Urbana). ), 2017 in this geographical category.
As this allotment is governed by the provisions of the Capital of Punjab (Development and Regulation Act) 1952 as amended from time to time, hence the rules made thereunder i.e. CBR(U), 2017, Chandigarh Estate Rules, 2007 etc. are applicable to you. . Therefore, you have violated the terms and conditions of sale/lease and city ordinances,” the notice said.
According to Chandigarh authorities, the requirement of ‘Solar Photo Voltaic Rooftop Power Plant as per Rule 4.1 of Chandigarh Building Rules (Urban), 2017 states that one Kanal house should have 1 KWp plant, two kanal house to have -2 KWp capacity center, Above Two Kanal, 3 KWP plant.
The notice sent by the Assistant Building Officer reads, “Now, therefore, the undersigned by virtue of the power conferred on me under Section 8A of the Punjab Capital (Development and Regulation) Act, 1952, I, hereby direct the allottees/minors/transferees. and a person who lives in a place to install a solar photo voltaic generator on the roof: submit to comply with this office.
In case you do not get assurance of compliance within 2 months, proceedings will be initiated against you under Section 8A of Punjab Capital (Development & Regulation) Act 1952 read with Rule 10 &14 of Chandigarh Estate Rules, 2007 as amended from. from time to time to resume/cancel the plot in violation of the provisions of Chandigarh Estate Rules, 2007 Chandigarh Building Rules (Urban), 2017.”
How many have entered
According to Chandigarh Administration officials, an estimated 1,867 homeowners have installed solar power plants at their residences while more than 4,500 are yet to do so.
Previously, the administration made it mandatory for houses over 500 square meters to install solar plants. Now, it has been updated to 250 square yards, which means that owners of 250 square yards and more need to install these plants compulsorily.
It was only after the UT Counsel requested to lower the house size criteria for mandatory inclusion from 500 to 250 square yards that this decision was revised. Notices of 250 square yards and above will be posted.
